Under the CURRENT rules (not Indy)...Deathstroke is in stealth on top of a building (standing on hindering). Batgirl is in a bush on the ground (in the square next to his)...can she attack Deathstroke? And why?

Yes she can, because she has Leap/Climb. Under the current rules, a figure with Leap/Climb can attack a figure in an adjacent square regardless of elevation.

She has Leap/Climb, and so can make a close combat attack against him despite the difference in elevation. This is a close combat attack, so Stealth and hindering terrain are irrelevant.
She cannot use ranged combat. LoF drawn to him will cross the square of hindering terrain he is in, and so his Stealth will prevent the attack.
As HeroComplex said, it would only come into play if you wanted to do a ranged attack. Then you couldnt.
But being adjacent to Deathstroke and with, <ahem>, the Huntress version of Batgirl just having a straight up ranged attack with no RCE or other ranged powers, it really doesnt effect you.

She won, cause I gave her the call on Deathstroke...well, not because of that, but that would have helped me out earlier in the game. So, in my usual fasion, I will now remake my entire #### team!
