It's not a loophole, it's been around since Hypertime (REV Flash is JLA and does this). It's not "free" in the sense that he still gets a token, but it doesn't count against your total number of actions for the turn.
It's been around since Hypertime, but I guess It hasn't been enough of an issue to warrent changing option 1 to a power action (which would be the easiest way to close the loophole).
But, now with figures coming out that have the Avengers/JLA with Hypersonic and a ranged attack (Vet Jolt & whatever's coming down the line) I think it's is time to look at that rule again and close it once and for all.
Seriously, it costs you a power action to even use phasing (which has no attack option to it, just a free breakaway, like HSS gets in addition to an attack), so I can't fathom how a mechanic that allows you close OR ranged attacks that don't come from your total allotment can be "ballanced".

The characters in question would lose nothing in capability if it becomes a power action, and lose nothing from being an Avenger.
Take R or E Northstar. If HSS becomes a power action, can he still take a power action like Amazo or KC Shazam or Kid Flash to do option 1? Yes. If he chooses to do a move action to carry a team mate or position himself, it won't cost an action from the allotment...just like it wouldn't any other Avenger.
I find your comment illogical; their point cost should remain the same.
In addition, making HSS option 1 a power action would curb the further amping the power gets from Unstoppable.
You know, MoE and IL members have been able to make attacks that don't count against a players total allotment of actions for that turn since day one, but I don't see people up in arms about that.

I find your comment illogical; you insist only the characters with HSS/Avengers lose functionality, and then mention how they lose the current combination they have with Unstoppable...
WizKids knows about these interactions (HSS/Avengers, HSS/Avengers/Range, HSS/Unstoppable). They seem to think they are balanced. You seem to disagree with them, which is fine. I just think that BigSoph disagrees with you. It looks like he feels they are costed properly now, and any decrease in power/functionality should give a point break to the power. (I'm not really all aboard on that; I don't think that retroactively changing characters point costs is ever going to be a viable answer.)
For my feelings on it: it's legal by the rules. I don't hate it, I don't think it's terribly broken, I've used it and I've seen it used effectively. I won't hate the game/WizKids/life/the world if they did change it, but they'd be nerfing some characters that they just came out with that they should have playtested for problems. It would disappoint me not because the mechanics changed, but because WizKids changed their minds between the finalization of Fan4 and whenever it is they released the new rule.

it's a hrd thing to pull off, and most of theose figures costs so much, that it's hard to fit enough of them on a team. There are also a good number of those figures that are useless.
So there's nothing to really complain about, because in effect, the TA kills any argument.

To continue with Darth Sabre's comments, most of the MoE figures do their real damage at range. So... not only do you have to be adjacent to the same opponent at the same time, and all your MoE figures have to be able to attack at the same time, BUT... for maximum effect, you have to be adjacent to a flier for it to work. And of course, your opponent has to be a complete moron to allow you to set all this up in the first place.
It's no wonder no one's up in arms about that. Chances are, you only get to pull that off once every 3 or 4 years.
In my day, we didn't have Heroclix. If you were being attacked by Superman with a 3d dumpster, you just had to hope you could outrun him.

No, sorry. You failed to read the fine print. The years quoted are just an average. Your SPECIFIC opportunity for a successful MoE/IL attack is in 2009. Good luck with that.

It has been pointed out to me that you can only make attacks, which skews the averages. It's now 5 or 6 years for a successful MoE/IL attack that does damage.
