He can attack you just fine. First turn immunity only applies to figures that are in their starting position; if you have characters sitting right next to his characters in his starting area, your characters are most definitely not in their starting position.
He would have to break away, yes. First turn immunity applies to attacks; break away rolls are not attacks.

First Turn Immunity only protects a character that is in the same square it was set up in. So Aquaman can run out (on your 1st turn), grab an object, and move back to the exact starting square and be protected by FTI.
FTI has nothing to do with FTI, so feel free to use Double Time Lockjaw to carry Joker over to your opponent and throw him off right from the start!
