Out of the Shadows:Once per turn, when Batman occupies hidering terrain and is given any action that is not a free action, before the action you may place Batman in any unoccupied square of hindering terrain 6 or fewer squares away to which he has clear line of fire.
OK, so when attempting to use this ability do you have to declare what action you are performing before 'popping'? As an example, at the beginning of his turn Batman doesn't have anyone within range to attack, could he still declare an attack action even if there are no legal targets until after 'popping'?

The action needs to be legal from the square where Batman ends his movement. The scenario you described is legal.
OK I have a question about this
We were playing yesterday and I tried to use OoTS here was the situation
I outwitted doomsdays Imp. then TKd bats over to him. tried to attack doomsday and then poof away. now we had a hearty debate about whether I could pop away or not, because the card says
"before the action you may place Batman in any unoccupied square of hindering terrain 6 or fewer squares away to which he has clear line of fire."
does this mean I cannot make an attack on doomsday or what? since it says before the action I can pop bats away does a melee attack not count?
To me no you can't if you won't based to doomsady. you could me away and then make a range attack. Now that I understand how the power works I would have to say no. But I'm not a expert or anything. Normalview are you out there Bro?

The declared action must take place after the move, as you quoted above. In your scenario, Batman can Outwit, be TK'd and then either make the attack and stay there, or move and make the attack.
Basically, it's move him then attack, not attack then move.
Just to clarify, Batman does not "move" when he uses "Out of the Shadows". He is placed. Movement would require break away when OotS is used. He is placed so he does not have to break away.

According to the RA the legality of the choosen action is determined based on where Batman can legally reposition himself to once he moves to a new hindering terrain position, not who he targets before he moves.
Thus declaring a range action could become illegal if you move adjacent to a non-flyer.
Also a close combat action is legal even though you don't start next to an opposing figure as long as Batman ends next to an opposing figure.
In the same regards, a close combat action is not legal if Batman does not end next to an opposing figure
As well, a ranged combat action can become legal even though Batman starts next to a non-flyer as long as he does not end near an oposing figure that invalidates a ranged attack on the target.

Yes, choose a ranged combat action targeting Doomsday instead and it will work just fine.

It sounds like you're asking if you can move away AFTER the attack is made which is not what the power lets you do. You can place Batman BEFORE the action. So it'd be perfectly fine to TK Batman out (into a square of hindering), Outwit Doomsday, declare a ranged attack using OotS, move Batman to a square of hindering (w/i 6 squares that he has LOF to) where he can see Doomsday and attack. You could also TK Batman next to Doomsday and make a close combat attack (as long as you were in Hindering). But you could not TK Batman next to Doomsday, Outwit, declare a close combat attack, roll and the move Batman away using OotS. That's not how it works.
