From the Golden age Players guide:

Cap and bucky 138points
Winter Soldier: Bucky - 70 points
Steve Rogers - 99points
Captain America(chaos war) - 60 points
Captain America(ca60) is 68 points
you would need to be 138 or under, so if you are set on using winter soldier you would need a model under or equal to 68 points.
You can merge into Cap and Bucky if you have 2 models over 138 but he cannot split unless he was previously merged by 2 models over 138.
....The most confusing thing is the thing you are confused about....
If you start off Split, then your two figs have to be equal to or greater points than what the Duo fig will be from the Sideboard.
If you start off Merged, you have to split into equal to or lower costed figs.

If you do start off with two or more higher pointed figs, you can still Merge back into the Duo as they we're the OG pair+ that formed the Duo.
The only way to get "cheaper" figs in the whole Merge/Split deal is to start off Duo/Merged.
And to answer your question...
As long as the points and names (real or "code") match/fall in line with what's on the Merged figs card, your good to go.
