Flying(in hovering mode), then he can make a ranged combat action, but only at a character that is b2b hith him.
Flying(in soaring mode), he cannot make a ranged attack at non-soaring characters, but may attack other soaring characters normally.
Grounded, he may make a ranged attack only if all opponents figures are flyers, and only against the figures that are b2b. If there is an opposing grounded character b2b with the attacker, then no ranged attack can be made.
You can never ranged attack a character that is not b2b with the attacker if there is any opposing figures b2b with the attacker.
how about if you are in base contact with an opposing character and you are flying(hovering) can you shoot with ranged combat expert another figure at distance?

Yup. This may be one of the things being changed in 2nd edition rules that come out with Indyclix, since there's been so much complaining about it - but for the time being, yeah, that's how the rules work.
Here's something I havn't seen anyone mention yet - which deserves clarification because I've seen a lot of people get it wrong:
you still can't ranged attack someone adjacent who has stealth and is in hindering terrain, even if you're a flyer. There seems to be confusion over this - people think you automatically have LOS when adjacent, because you can do close combat attacks against Stealthers. What they get wrong is that close combat does not take LOS into consideration at all - THAT is why you can make close combat attacks, even when you don't have LOS. Outwit or ranged attacks still cannot be used in that instance, even tho you could make a close combat attack.
