Thinking of playing this guy and had a few questions on him.
In regards to:
The Pact: At the beginning of the game, you may announce a pact. If you do, the highest point character on your force and the highest point character on your opponent's force (300 points or less) can't target opposing characters with an attack until one of them has taken damage from an attack or, they are the only 2 characters on the map, or your opponent only has one character on the map. This ability can't be ignored.
Question 1: What happens if there are multiple characters on the opponents force that are the same points and are the highest point characters?
Question 2: What happens if your opponent has a character higher points than 300?
Questions 3: So if I do things like Poison and other things that aren't from an attack, does the pact still stay?

3. You are correct. Until they are the last ones, "until one of them has taken damage from an attack" is the only way to break it so non- attacks like poison don't violate that.
-Heroclix is not a game of logic, it's a game of strategy .... after all, when's the last time that you saw a giant (using a stealth ability) that was hiding behind a swingset... and nobody could SEE him????

This is incorrect. WK changed this in 2017 to allow for ties that are broken by the active player.

Good catch! I was going by the last ruling and totally forgot about that update (hasn't come up in one of my games yet).

As for Wolverazio's response, I can see that... I misread that part of it.

Does this apply to Duhg, as well? Can he (once again) have friends who are 125 points?

He'd work now. The clarifications got around all that. He can be the highest point character even if there are other highest point characters.

I disagree with the binary reasoning, the CRS handles that, but I do agree that I don't think that is in effect during force construction.

I know he quoted the clarification. That clarification specifically does not say what you seem to be thinking it does, however.
Also, I'm not sure where you think I said the Active Player rule applies during force construction. It very plainly does not, and I'm fairly certain I have never said otherwise.
More likely, you're attempting to conflate the fact that "during force construction" effects can be applied in the order the player chooses. This, however, has nothing to do with the Active Player rule, and has no bearing on Dugh's effect. His is a binary, yes/no check with a passive effect.

During Force Construction, there is no Active Player. Therefore, this exception cannot be applied. Again, this is pretty cut and dry.
"Does it work" and "should it work" are two very different questions with two very different answers. I am simply answering the former, which is a very straightforward "no, it does not work". The answer to the latter is "yeah, probably", and it should be up to the judge/playgroup to make that decision.
