Apparently Marvel and DC have filed a joint suit in order to try and copyright the term "Super-Hero" as another ploy to drive the independent companies out of business. You can read it here:

it makes a point "super-hero" is all of our words.

thats like me running through the dictionary and adding TM to everyword i like and trying to gain it than make it so it wont be allowed to be included without my permission.

Already done. That's why indy books have to use terms like "metahuman". It's actually been that way for years.
