Phoenix, Psionic Maelstrom and when to check powers

Colossal Retaliation: Psionic Maelstrom: FREE: If no friendly character has been placed this turn, choose an opposing character that attacked Phoenix or damaged a friendly character since your last turn. Place Phoenix within 3 squares of the chosen character then make a range attack targeting that character and all other opposing characters within 3 squares, regardless of line of fire. Instead of normal damage, deal each hit character 1 penetrating damage for each action token they have. Hit targets that can use Incapacitate, Mind Control, Outwit, or Penetrating/Psychic Blast modify their combat values -1 until your next turn.
I can't think of a power that is worded like the bolded portion, so I just want to ask when you check to see if the hit targets can use the listed powers? Do you check when you hit or do you check after dealing damage? So if she hits two characters and one has mind control but loses it when he gets damaged, and the other does not have mind control but can use it after he gets damaged, which one gets -1 to combat values? My vote is the one who has it after damage, but I wish it said "after resolutions" or something so I felt more certain.
This is probably an easy one, but I'm okay with that.
It checks on hit, much like Knockback, before the hit characters take damage.

If character X is hit by Rachel, even if it doesn't have one of the listed powers when hit, X's combat values should be modified if it has one of the listed powers any time prior to the beginning of the next turn of Rachel's controller.

Yeah, looking at it again, I was reading it as a trigger for some reason. It's actually just a passive effect that applies to the hit character regardless, which just checks to see if that modifier will apply when values are calculated.
Either way, it takes effect until your next turn so they lower their defense -1 if they can use any of those powers after taking damage.
Edit: to clarify, it takes effect on hit and the hit character lowers their defense until the effect expires or until they no longer fit the requirements of the effect.
Glad I asked! I considered Joe's interpretation and ignored it because I was sure it was the wrongest option. I just don't do well with this type of effect.
So to verify and clarify, if a figure hit by her can use one of those powers in that timeframe, they get the - 1 only while they can use the power, right?
So if they can use incap and I OW incap, do they still have the - 1 to stats?
-Heroclix is not a game of logic, it's a game of strategy .... after all, when's the last time that you saw a giant (using a stealth ability) that was hiding behind a swingset... and nobody could SEE him????

Outwitting them prevents them from using Incap et al, so they should also lose the stat penalty.
