People began putting them on their force and scenarios were never used, which is why Mary Jane, Alicia, Jarvis, and Alfred are still banned in Golden Age. The rules just disappeared when Bystanders were thrown into boosters (Mutant Mayhem if I remember correctly).
Those figures are not banned in Golden Age games. The only thing banned in this game are the orange bordered feat ATAs.
The entire sheet of pogs were considered PROMOTIONAL by the time Icons was released. When I am not at work I will be happy to locate the 8 year old ruling about them.
It still doesn't change the fact that the bystanders from the Adventure Kits were part of scenario play, meant to be played using Captive rules, so that if they are still used, so then should the scenario.
That would be like allowing Horde tokens but not allowing them to stack.

I can't authoritatively speak for discussions prior to the Universe rules. I wasn't playing the game then, so I was not partaking in any such discussions.
I can, however, say that they have never been considered to be promotional at any time between Universe and now.
Also, the bystanders were not simply only for scenario play. Those map sets included scenario cards, but those cards were not the only ways that the original bystanders were to be used. Additionally, as they were just scenario cards, they were never part of the core rules, thus the rules therein were not part of the core rules.
