Is it because flurry allows you to make two 'attack' actions, not 'power' actions as they are now known? What does bcf count as? This really does not make sense. But this game doesnt at times, sometimes the wording of the power and abilities descriptions just dont make sense at all.

The two attacks of Flurry are not actions, they are just attacks. Since Incapacitate requires a close (or ranged) combat action to activate it you can't use it (you don't have the action to assign). BCF does not require an action to activate it, it can be activated for free when the character is given a close combat action (which is what you did to activate Flurry).

we all know what bcf represents lets just go nuts about why nightcrawler is carrying a sword but doesnt have bcf lol and i already know the answer what with him being TOO sick, heck thats true lol

The rulings and clarifications from septrmber say incapacitate may be used on the same character twice in one round.This will happen only if a character has both incapacitate and flurry, or if the same characteris attacked twice in the same round by two different characters that have incapacitate

The rulings for September were a facet of the old rules system, however, and no longer apply, which is why they are not listed with the most recent FAQs.
Judge Hershey cannot use Flurry and Incapacitate together.
