Are the SwitchClix figures for the Gotham City Strategy Game going to be Modern Age?

Is it considered a DC Heroclix release?

I know it does not come out till next week, but since there have been official previews, I thought this could be answered.

As far as I know, anything that's labeled DC, Marvel, or Street Fight are all tournament legal for Modern format purposes. Figures coming from special releases like TABB or the new strategy games should not matter.
