TWELFTH-LEVEL INTELLECT: Brainiac 5 can use Outwit. Once during your turn Brainiac 5 can use Perplex or Probability Control.
TTPC restriction in question:
Quote
Must not be able to use Probability Control through
another game effect.
If B5 choose perplex in his previous turn, could he still use TTPC on the following opponents turn?
AND
N&Bs special attack:

COMPLEMENTARY COMBAT SKILLS: When Nightwing and Batgirl use the Duo Attack ability, they can use Flurry as a free action instead of each attack.
Duo Attack:
Quote
Give this character a power action. This character makes 2 combat attacks (close
and/or ranged) as free actions and possesses during this action.
Flurry:
Quote
Give this character a close combat action. After the close combat
attack resolves, it may make a second close combat attack as a free action. The first attack doesn’t activate the Damage Depletion Modifier
Free Actions:
Quote
A character may not activate the same game effect twice in one turn with free actions, unless the game effect indicates otherwise.
How many attacks can they actually make in one turn here? And does the damage depletion rule affect any of them?
1. Brainiac should be able to use TTPC as he can't use probability control at that time
2. You can use flurry for each free action because the power specifies that you can.
Your first flurry has no modifiers and the second flurry would be subject to the damage depletion modifier (but only -1 for both attacks).

Landoman is correct like always...(thor says what?)
Brainiac is similar to oracle dc 10th. She can select perplex, outwit and prob what ever she chooses she can use that ability. She can get by without prob for jl or birds of prey theme team selecting out wit or perplex instead of prob.

I agree with all this.
aqhoffman- greatest post possibly ever
jtallday- Jon I wouldn't challenge you if I wasn't sure you are wrong cuz I don't have that kind of energy.
For Brainiac 5 i would say because he can use prob he couldn't use ttpc.
Batgirl and nightwing uses flurry once for each attack of the duo attack. So they swing 4 times. The second two have -1 dmg
For night wing an batgirl, if you choose not to make the second attack with your first flurry. All three attacks will be at full damage. Very useful against damage reducers.
