I can't figure out why both DC and Marvel are so set on maiming good characters in the name of "good" (bad) writing.
The two companies are racing to see who can kill off the most first. Hence the rumour they started first about Sue Richards being killed off... and she was, but not in the 616 universe. Same thing again with Spidey, they had the rumour going and sure enough, they killed him off, but not in 616 (see: "Beyond"). It's all a ploy to drag people back to comics and in some cases to try to revive char's by killing them off anf having new chars take their mantles on (Blue Beetle).

Yes, their being sued for the rights to Superboy, because the families of either Shuster or Siegel (or both) still had some ownership rights to Superboy. And for what it's worth, it's different than the rights to Superman.

Here's a rough explanation on the subject of the law suit from Wikipedia (I'm sure there's more concise and accurate information to see, if you look for it)

At the San Diego Comicon, Dan Didio and 52 editor Steve Wacker remarked the death of the modern Superboy was not implemented because of the verdict. It was deemed necessary for dramatic beats, seeing as how the character could simply be renamed.
The new Legion of Super-Heroes cartoon will feature "a young Superman" instead of "Superboy."
