I want my 60 fig Marvel set.
I think case sales would take a huge dip (based on a 60 fig set ) I'm getting a case, or even a 6-12 box set if it's half full of DC.
Also, any box set or case is going to have to have the requisite hero's. so not only would we see yet more Ironmen/batmen/supermen/spidermen etc, but our chance of lesser known hero's would be severely curtailed.
The money Wizkids wanted us to pay for the Watchmen set, I'd gladly fork over for an Amalgam Set:

If you notice theres never been amalgam action figures(That ive ever seen). Splitting the merch rights would be too difficult for either company to agree.

Too true. Look how long it took them to get the Aliens vs. Predator movie off the ground. They hemmed and hawed about that for the better part of a decade, and when it finally came out it was a dissapointment. I'd rather they make good clix and not get ones made that will come out crappy just to get them out on the shelves.
Think about it. Can you see either company letting the other have the better sculpt? The better dial? It would be a legal bloodbath.
