Broken is relative, but the game is balanced for (or rather tested for) 300pts. In a standard game (or even non-standard) I am much more likely to see Nightcrawler than CSM, statistically speaking. So, I'd have to go with Nightcrawler.
That and Cheung admitted he designed him to steer game in the direction of he wanted it to go, which is 'away from tentpoles'. Where there is an agenda there is borken-ness.

Yep. Which is crap, IMO. The game doesn't need to be any more munchkin-friendly than it already is.
Longest-Reigning Drunken HeroClix Champion - anyone got a liver?
One of these figures can't be played in a 300 point tournament, which is the standard for most major events.
The other one showed up on something like 80% of teams at Clix for the Cure, the last big tournament I can think of (when is clixathon? It's so far away, distance wise, I didn't keep up on it, whereas C4TC is only like a 4 hour drive I didn't embark on).
One of these can make theme at 300, 400 (heck, even 200) point games. The other cannot.
One gets smoked by mystics+wildcards. The other has a ton of other cheap, efficient figures that can pick up the slack, and easily heal with the TA.
One can move your figures wherever he wants, the other one can merely see them wherever they are. One can move through terrain while making a HSS attack, the other can just see through it (with an effective 5 range on the first couple clicks).
As for outwit, it's a moot point. How many figures have outwit and can see through stealth, Or, if you're playing someone good, see through walls?
One is the best figure in the game, the other is the one people think is the best figure in the game (they are wrong, and merely think the best figure would have to be 300+ points).
It is not contrarian. They are commenting on what appears to be an absolute lie. "I like to use" means that it is a tactic he has used and implies that he has used on more than one occasion. However, he could not have employed that tactic without either 1) cheating or 2) his opponent forgetting that he had Power Cosmic or 3) his opponent turning off his own Power Cosmic in response to a declared action, like the outwit, none of which makes any sense.

Neither is as bad as so many people on here think.
Cosmic Spiderman is a bit more over the top then
Nightcrawler, but both are very beatable. I've played
against Spidey five times played by five different players.
All of which were solid players. Beat him 3 out of 5 and
just barely lost the other two. All with teams not designed
to take him on. Nightcrawler is only as good as the team
around him. By himself he doesn't do much, just get him to
push and he goes down fast.
Well Cosmic Spidey has the Power Cosmic TA, so you can't outwit his defense. But I am with you though. Herc can still ruin him for 6 damage all together if Cosmic Spidey can't roll impervious. Both figures are beatable.
I have actually used neither figure yet (I got both of them), and I am happy Cosmic Spidey exists as a piece since I am a Spidey fan. But I used Thor and Loki once and felt dirty afterwards. Cosmic Spidey invokes the same feeling just looking at him.
'Crawler will be coming out for GSX events however
And this is why NC is worse. WIth GSX, you're gonna see a lot more of him. How often do you really see Cosmic Spidey. In a 400pt game, he should be beatable most times.

There is no such thing as a conservative hero.
"You lost today kid, but you don't have to like it!"
I haven't fought him, but SPidey seems the obvious choice. Nightcrawler has his own level of meanness though.
coming soon : nu52 Hercules
