The power say "can use Battle Fury", it becomes optional. So whether the figures starts or ends within 3 squares of First Born, they can choose not to use Battle Fury to make a range attack. For Battle Fury to be always active, the power would say "possess Battle Fury".
This is wrong. "May" is the optional one, "can" means must.
Possessing Battle Fury means that the power can be OW'd... that's the only real difference between those powers.
-Heroclix is not a game of logic, it's a game of strategy .... after all, when's the last time that you saw a giant (using a stealth ability) that was hiding behind a swingset... and nobody could SEE him????

Once you are within 3 of First Born you have battle fury. You cannot chose to not have it. If you somehow can get a friendly that can outwit you can do so. Once you enter 3 squares you get it. So if you running shot into it POOF attack gone. Battle Fury is a power that is always active. You cannot just CHOSE it. Posses keyword simply means it can be outwited

For those wondering, it is under "Use and Possess" on page 18 of the Rulebook, second paragraph: "A character uses a power if a special power or an ability states that they “can use” or “uses” that power."
