Can you elect not to use empower?
Reading the power it does not say may or can use?

Empower works like Enhancement. Neither are optional. If you are next to an Enhancer or Empowerer you get the +1 to damage. That being said, their could be something about the Back-Alley Brawl BFC that I don't know about.

Feel free to ask on the rules forum to confirm, or ask vlad3theimpaler. I doubt you'd get an answer from WIN on the subject.

CaptainNifty is correct. Empower and Enhancement are always "on," just like the powers that reduce damage.
