Is there any chance of say a state championship that ends up with 13 plus people opting for a top 4 instead of a top 2?

It's a little sad to play in an event calling itself a state championship but only have a top 2 due to a turnout in the upper end of the 9-16 range. I think the general approach for ROC works well for regular ROC events, but with something being a state championship it seems like it should have a bit bigger cut for elimination.

If I were to propose something it would be 12 or less, top 2, 13-20 top 4, then follow the standard ROC format from there up.

There is some slack given. When it comes to Rounds and a larger cut, especially for a venue that gets a low turnout, as long as the Judge explicitly points it out before the tournament starts, and everyone is good with it, then it is fine.

Good to know. I know last year for Oregon it was a bummer to miss top 2 because of a close loss to the guy who went undefeated.
