The US government can and has taken that right away, when they have had to for public safety. The Japanese interment camps and the treat of Arabs post 9/11 are just two examples. Just (if not every right) the US constitution guarentee's can be taken away in the right situation (as far as I know)
The problems are 1) The safety of those heroes and their families and 2) How much control the government will ahve over those heroes.
It's technically illegal but they're never called on it. Noone can force them to stop.
Example, the Trail of Tears. Those Native Americans WON in the Superme court who said "You can't move these people, they want to join the US, to kick them off their land would be illegal."
Jackson did it anyway. The Supreme court doesn't have an army, they can't arrest him or anything.
The government does a lot of illegal stuff. There just isn't anyone to hold them accountable.

I only browsed the article where they talk about this but yeah, they did suggest that Thor and the clone would have to meet up one day and Thor wouldn't be too happy about it. They even suggested that Odin might be coming back and even he would be concerned about humans cloning gods.

The person coming to my aid is morally corrupt and deserves imprisonment unless they work for the government? The government should have the right to sanction helping people?
Which people, I ask?
Would the current administration fully support a hero who actively campaigned against Guantanamo Bay? Would they fund this hero's press conferences?
What if the government began exterminating Muslims? Would they continue to fund and sanction heroes who refused to kill them?
We are only having this argument because it looks like it would benefit us to have the heroes registered.
How willing are we to do anything for our own benefit?
And don't forget during Simonson's FF run, it started with a story about a proposed Superhuman registration storyline. And Reed was TOTALLY against it and proved to congress it wasn't right.

Just remember, Thor had been cloned before. The High Evolutionary did that. Thor needed Loki's help to defeat another. Strange how what comes around goes around. I suppose next they'll clone Spider-Man or something. Now that would be horrible.

Let's not forget that, if you are in an accident, you may be dying. Someone comes by, saves your life. You'll live. You can sue the person who saved your life. Strange, but true.

Not quite true. Good Samartian Law means that it's only if it's a trained professional that saves you that you can really sue (you can attempt a law suit against a true "Good Samartian" but the laws tend to kibosh it really quick). Basically, what that means is if you're in a car wreck and, say, the local milkman stopped to help you, you likely can't sue him (as long as he wasn't grossly negligent); if someone who is trained stops to help you, they're open to lawsuit because they are supposed to have "special knowledge". It's one reason it makes it tricky for doctors, paramedics, etc. out in their civilian life to stop and help someone; you'll find many of us just don't acknowledge who we are if we stop to aid. It's an invitation to get sued or have our license suspended during investigation.
