Im wondering where you can find the official rule about not giving a character you have TK on and use action with a token. I swear everyone has been saying it and I think I even read it but i can't find it on hc.com at all. I really need to print this out for playing with my friend. Thanks in advance.
Yes I apologize if my meaning was unclear.. I understand who gets the MCer gets the action token for sure I need to pront the ruling that says the target takes no action token. I have 3 versions of the rules, even all the ones directly off hc.com and all say he takes a token. Ive even found where you can make someone who has 2 tokens can still be tked which i think proves the no token thing to stop people from pushing there character to avoid MC. I need to print it out so a link would be sweet. Thx to all..

Mind Control use to give an action token to the MCer. BUt that changed with the INdy Rules Update.
Now when you MC Someone you give them a Free Action which can be used for any available action (Move, Power, Attack or Free Action). So no token is given for Free Actions. So you can MC someone who has 2 Tokens.

The target figure who is Mind Controlled does not receive an action token.
First, you must read only the current (Universe) PAC. Otherwise, you will be confused.
With that, the Universe PAC says this:

MIND CONTROL (optional): Give this character a power action. It may make a close combat or
ranged combat attack. A successful attack does no damage; instead the target becomes friendly to your force and opposing to your opponent’s force. Each successfully hit target may be assigned any action as a free action. Immediately upon resolving its action, each target becomes an opposing character to you and friendly to its owner’s force. This character takes 1 damage for each 100 points of the targets’ combined point value. If this character has a range value of 0, treat its range value as 4 when using this power. This range cannot be further modified.
(Emphasis mine.)
Since the action given to the target is a Free Action, it follows under the Free Action rules:

If you give an action (except a free action) to one of your characters, mark the character with an action token,
Since the Action Given by MC is a Free Action, the figure is not assigned an Action Token, and, as per the FAQs, you can MC a figure with 2 Action Tokens on them:
