Actually, the wording on the card should work both ways (unless I missed something, which is possible). You can use it on your own attacker to do 5 breakthrough, OR you can use it on an opponent's attacker to have them do 5 breakthrough (not a usual play, but if they're hitting you for like 15 breeakthrough you can use it to reduce it to 5).
HeroComplex quoted something from the comprehensive rules midway through the pre-release thread that made it pretty conclusive; that it would always be referencing the defender's controller because their character is the last one mentioned. Something like that.
Edit: Here is his quote.
Quote
That <Something>, The <Something>
An effect or modifier that refers to "that <something>" or "the <something>" is referring to the most recent card, player, or object described by <something> mentioned in the card text. That card, player, or object is still the card, player, or object referred to even if its description has changed since the previous reference so that <something> does not currently describe it.
Which means that you're equally right, Kim---either player can use Death Times Five, but no matter who does so, it's the defending player who gets hit for 5 (non-breakthrough) endurance loss. Essentially, either player can turn an attacker into Mystique, Raven Darkholme for a turn. :)
