This past Tourney my judge caught me off guard and said a flier (in hover mode) *CAN* break away without making a break away roll from a non-flier figure based against him.
I thought this was odd cause when base to base I though only L/Cers, Phasers, HSers, and fliers in SOARING need not make a break away roll vs a non-flier.
He said - "It's right there in the rule book, read it." So I did. On page 19 (break away section) of the new universe rulebook it says that characters with flying (who are in hovering mode) ignore the effects of grounded (non-fliers) on MOVEMENT.
SO who is right? if he's right, which rulebook/FAQ update should I refer too?
The question comes down to this: Can hovering characters without any special powers, get free break-away from a grounded figure?
No, they cannot. When the character is moving from point a to point b, he can ignore figs inbetween there, but they still have to break away in order to start movement. The break away check happens before the movement begins, therefore the flier doesn't ignore figs yet.
The wording on the whole thing could be better, but here is why a flyer must still roll breakaway:

For purposes of breaking away and close combat, consider a hovering character to be at the level of elevation its base is on.
Again, it could be worded better, but the current interpretation is that a hovering flyer must roll breakaway from adjacent non-soaring characters. However, once moving, the flyer ignores other characters during the movement.
as stated flyers may move freely and do not get tied up by moving next to adjacent to figures it only when they end their move next to a figure, or at the begining of the your turn if your flyer is based they will need a break away roll.
