But the difference is the Skrull stuff had been building up for some time and it's Marvel's big event, whereas Atlas just showed up in Superman when James Robinson started his run. There was no hype building up Atlas' appearance in Superman, AFAIK. Still isn't much now. Seems like there's more talk about what Johns is doing with Superman right now, and WK has that covered nicely with Superman Prime and the LSV in "Arkham."

It's still current....I think Batman RIP, the Superman books, general Gotham Villains and some cool generics should fill up the whole set. And obviously some random DC villains.
I also think there's too much focus on remakes, like I love having a legal version of all the main characters but have them and who they're currently fighting and if it's someone old then it deserves to be remade...not just cause there hasn't been a Penguin for a while...especially since there was one like before the summer in Alpha =P (yes, to me that counts).

I won't spill Boneyard's spoiler list here, but from perusing it, it looks like most of the villains listed have had recent comic appearances. The problems with trying to get someone like Atlas or other "new" characters into the set include a) no fanfare, b) no guarantee what the character's abilities will be like in the comics because of WK's long lead time, and c) no telling if the fans will even like the character (see Forerunner).

Well the sets should reflect what's currently going on and be general...atleast I think they should...

The problem is the lead time. remember Manhunter in Collateral Damage? Seth actually said he wished they had saved her for a later set as her powers changed between the decision to include her and when the set came out. She just hadn't had enough 'page time' to define her yet.
Sinestro War was the same way. Not enough was knwon to make that event into the Crisis set. But the buzz about the event was noted by WizKids and if you check out Boneyard's rumor list in the rumor forum, you can see that will be represented in AA, the next available set from when the story happened.
IF Atlas is a big deal, then maybe in the following set. It gives WK a better chance to define the figure more accurately.
