I was looking at Ebay today and noticed that some stores have full listings for Web of Spiderman with complete pricing for each fig and complete sets. I know that the buyer will not get the items until after the release of the set, but is it still allowed to "sell" Web of Spiderman beforehand?
Also, I am guessing that the pricing on the SuperRares is based on a popularity guess buy the store owner. Example, Deadpool $45 and others much lower.
So long as the seller isn't making any claims about immediate shipment all he's doing is taking a chance that he'll have as many of each as he apparently plans to. Once the sale is made he's fairly strongly obligated to obtain and ship the piece once the set's out.
Given all the info that's out on this set so early he's dealing from a more comfortable place than many pre-sellers have been.
As for the pricing, it's a shot in the dark. A pre-seller is likely going to try to trade on the novelty of the set along with the rising anticipation to lock in prices that will be higher than what the market will be bearing even a few days after the set's released. (Not all, of course. Some are just getting things set up with as reasonable pricing as they can so as to make the sales now. Ideally they'll have the money come in and quickly have enough to cover their initial outlay for the bulk product.)
If you want to sell presale items, be sure to meet all of the following criteria:

Guarantee that the item will be available for shipping within 30 days from the purchase date. Be sure to clearly state this information in your listing.

Clearly indicate in the listing that the item is a presale item.

The handling time specified in your listing should reflect the time from the end of the listing until the item is shipped to the buyer—not the time the item is in your possession. Be sure to specify the correct handling time in your listing.

In the listing form, you need to use the default font size of 3 so people can easily see these sale terms.
So basically you can presell 30 days before release date so long as you state it's a presale.
