Am I wrong for reading that the check for the Theme Team and the stat modifier are only "when building your force"? His trait is only 2 sentences, both connecting to force construction.
The second sentence says nothing about force construction.

The second sentence doesn't have anything to do with force construction.
+5 CONTRACT KILLER: When building your force, a themed team may include Deadshot and still be a themed team if your force includes a character with a point value greater than 80. If your force doesn't have a character with a point value greater than 80, modify Deadshot's combat values by -1.

If both sentences are related to force construction then there would be literally no reason at all to include the underlined bit.

If you pay to use the trait and at some point you don't have an 80+ point character on your force then Deadshot get -1 to values.
If the cost for CONTRACT KILLER was paid, and there is no character greater than 80 points on your starting force, Deadshot will count towards the theme check.
The effect is passive and continuously checks if the force has a character greater than 80 points on that force. If no such character is on the force, then Deadshot will have his combat values modified by -1.
