Tony died years ago, before Onslaught. Replaced by "Teen" Tony. Heroes were then shunted to the Franklin-verse, and he became an adult there. The Heroes were then "Reborn" and tony was back to being an adult. And everyone seems to of forgotten what a huge prick he was before he died that first time.
Plus, he's been known to fake his own death a few times now, starting with the original "Armor Wars". He's annoying like that.

Also, there is the alternate universe Tony running around as well. You never know. Might just be him.
