-Heroclix is not a game of logic, it's a game of strategy .... after all, when's the last time that you saw a giant (using a stealth ability) that was hiding behind a swingset... and nobody could SEE him????
And "figure" is the keyword here (no pun intended)... bystanders are characters just like figures are and are now permissible on theme teams, but they do not count towards the total required for a theme team.
I don't consider bystanders to be figures... figures are actual sculpted playing pieces that are also characters in the game; bystanders are just character tokens.

Poor Invisible Woman, Atom, Antman and Shrinking Violet, they aren't pogs or figures. Just little hockey pucks with stat windows...
At least they get keywords.

I know that there is a confirmation that there can be a non-generic theme of 2 in a 300 point game from the RA.
I have yet to see any evidence that there is ANY minimum anymore. In a 100 point tournament.....it LOOKS like you can have as little as 1 character to make a Theme Team!!!! you would never get the PC bonus....but the other bonuses apply.
There is no longer a minimum character requirement. The Theme Team rules in the latest Errata and Clarifications document completely replaces the Theme Team rules in the rule book. Here are the theme team rules:

For the purposes of building themed teams, generic keywords are the following: Animal, Armor, Brute, Celebrity, Cosmic, Deity, Detective, Future, Herald, Kid, Martial Artist, Monster, Mutant, Mystical, Past, Police, Politician, Psychic, Reporter, Robot, Ruler, Scientist, Soldier, Spy, Teen, Warrior.
