it states......DARK BARGAIN: Mephisto can use Incapacitate. When Mephisto successfully hits a target with Incapacitate, the controller of the target can choose either to give an action token to the target normally, or to roll a d6; on a result of 1-4, deal the target 1 unavoidable damage.

if he rolls a 5-6 does the attack miss totally? no token or damage?

I think that's the bargain. You either take your token or take your chances with the roll. I would assume on a 5-6 nothing happpens.

Galactus has it right, and it's why Mephisto is a pretty bad piece.

Having a built in stunning blow feat doesn't constitute a bad piece. Plus the damage is unavoidable. There's so much potential in the overlooked mephosto figure its ridiculous. Actually put stunning blow on him, outwit reducers, incap, the target receives 1 unavoidable AND 1 damage with an action token. So with some perplex and luck....mephisto is dealing two damage plus incaping two figures a turn. This version is the creepy hiding behind the shadows mephosto...not the cosmically powdered god mephosto....that version is being released soon.
