I read the rulings for this thing on UDE and I think that they totally butchered the point to the card.
It says on there that LV monsters that cannot be summoned except by the effect of the card in the card text cannot be brought back with Level Modualtion unless that monster has already been summomed correctly beforehand.
Perhaps it's just me but I think that this does not make sense. When then does that card say "Ignore the Summoning Conditions" and yet it is still enforceing some of the conditions. By saying that the card must have been summoned properly once before in order to be brought back by Level Modualtion is adhering to the Summoning Conditions.
Umm...not necessarily....the card merely says to ignore the summoning requirements so people don't get confused by reading Modulation and the LV monster itself since the highest LV is usually a Nomi that can't be special summoned any other way except through the previous level. It's just telling you that you don't have to worry about that.
Also the rule MAKES SENSE too....if you could just dump Horus LV8 and revive it like that, then despite the downsides, it'd be a little too powerful for its own good...
Rulings
An "LV" monster that normally cannot be Special Summoned except by the method in its text CANNOT be Special Summoned from the Graveyard with "Level Modulation" unless it has been previously Special Summoned by the correct procedure. The "ignore the Summoning conditions" text allows for these monsters to be Special Summoned only after they have been properly Summoned by their own effect. This applies to "Horus the Black Flame Dragon LV8", "Armed Dragon LV7", "Silent Swordsman LV7", "Silent Magician LV8", and "Winged Kuriboh LV10".
You cannot activate "Level Modulation" if the opponent has 1 or less card in their Deck, or if you have "Protector of the Sanctuary" on the field.
Even Continuous Effects on the Special Summoned Monster, like "Horus the Black Flame Dragon LV6", are not applied during the turn this card is used to Special Summon that monster.
If the monster Special Summoned by this card's effect is flipped face-down, then the restrictions of "Level Modulation" are no longer applied. If you flip it face-up again, it can attack and its effects are applied.
i originally questioned that ruling to. since level modulations does have pretty much the same text as "level up!" so you'd think they should work the same. but like HDI said level modulation would simply be far too powerful.
the question i have is this. would summoning horus LV8 with "level up!" be considered properly summoned for the purpose of "level modulation"?
it never made much sense to question if a nomi monster was properly summoned. you can say they are never properly summoned, since they can't be resummoned. or you can say that, if summoned at all, they are properly summoned, since they're designed so they can't be summoned improperly.
so does level up! summon properly because it still manages to summon the nomi, or is it improper because its not the text written method?

I believe the only way to "properly" Special Summon a higher, nomi, LV monster is through the effect of the previous level.
The way I see it is that using Level Up! for a higher LV monster is like using Metamorphosis for an equal level Fusion.
It special summons it, but not properly summons it to enable the fusion to be revived.
I believe Level Up! would work the same way like that, so Level Tuning wouldn't work on a "Level Upped!" monster.
thats what i figured, and i doesn't really affect me since i don't play LV monsters. i actually think its funny that level up and level modulation dont get along, usually cards based on the same theme work together nicely, oh well to bad for horus players.
