If you swap it and its killed, does the original owner (the one who owns the phoenix) still get the effect. Heard its different than the other cards like mystic tomato/ect. So if anyone can give me a link to the ruling on this I'd appreciate it.

No...there is nothing different...

While this card is in face-up Attack Position on your side of the field, negate the effects of any Spell or Trap Card that targets 1 Machine-Type monster on your side of the field. When this face-up card on the field attacks or is attacked, and it is destroyed as a result of battle and sent to the Graveyard, you can draw 1 card from your Deck.
...since there is NO text specifically stating "the controller of this card", then it is assumed to always go to the OWNER of the card since it is a Graveyard-activating effect.
