The one I ahte is that a unit in shallow water can't be charged from outside that wter, so a player tries to bring a 2" square piece representing water to park a mech in. NO!

Actually, they can be charged. They can't be attacked in close combat (thus can't be captured).
These rules for custom terrain were in the old General Tournament rules document. They document has since been superceded, and the new Approved Play rules don't include such a provision, so they aren't allowed. This could be changed when WizKids updates the Mechwarrior tournament rules, but I doubt it. WizKids has been stating for a while that only terrain templates would be legal in tournaments.
Game venues usually provide battle boards and the official terrain for use of the players as a common courtesy. Bringing your own is for the most part not required.
Now IF you want to volunteer to build a few extra battle boards I am sure that most venues will be glad to replace the worn boards.
I looked up the rules per the Official Tournament Rules on the Wizzies web page....

All Standard Terrain Templates are tournament legal. Elevated terrain may not be used.

These are of course those paper cut out shapes that you can download. So for official tournaments, as of now, you are stuck with those paper doll flat shapes.
If you would like to make a request for change making 3d "Tournament Legal" all you have to do is to get the wizzies, TOPS actually since they bought out the wizzies months ago, to change the rules.
On a strictly personal level I prefer the non elevated paper shapes. You can actually SEE the unit hiding behind the building without having to actually get up, go around and look at pieces behind a physical barrier over and over and over and over. LOL heck if I wanted to exercise I would have gone to the gym.
I personally rather like using 3D terrain in games when possible. My venue hosts Warhammer 40K games on a regular basis as well as MechWarrior, so from time to time players like myself would use smaller pieces of 40K terrain or other buildable 3D terrain in unrestricted tournaments.
Actually, you can use 3D terrain as long as its dimensions match the paper cutouts exactly. However, making things too tall is a pain for measuring distances. Most players around here who don't like the cutouts use foamboard for blocking or felt for hindering and water.
The one thing to consider is the ability of players to look over terrain to see their pieces. I run events in two stores. During large events at my one store, I have 6 mats lined up on tables with no breaks. So for the guys by the wall, they would have to walk around 2 other 6 ft tables just to get to the other side to look at something (or stand on the chair).
I have a similar problem with my other store but its only 2 mats per table so its not too annoying other than not having room front to back.
Also consider those with handicaps and cannot stand to see things.
The couple times I have played with 3D terrain, I have always used a 2d piece in the map with the 3d on top. It spends almost as much time off the map than on the map.
