The opportunity provided to us by TBS' DC Legends - Fan input was awesome, so here's a little initiative seizing.
What would you like to see in the Marvel set to follow DC Legends? It could be as big as what teams you'd like to see them feature, or it could be as small as a single legacy or pre-legacy card you'd like them to include.
Since I doubt I would get an X-Factor Investigations mini-team...a Layla Miller on the X-Men with the version X-Factor Investigations, and the flavor text "I know stuff." A Rahne, Monet, Jamie, and others would be awesome, too. But, definitely a Layla.
Ah, yes. And, the thing I want most for my birthday/the Marvel Legends release: NEXTWAVE. Because, according to their theme song: "It's like Shakespeare/But with lots more punching."
They could do all the art as homage to older cards! I want a Zombie Longshot. I want it bad.
Activate, name two different cards -> Target opponent reveals the top four cards of his deck. If both named cards are revealed, Longshot eats them, and they go in the KO'd pile. Otherwise, put all revealed cards on the bottom of that opponent's deck
... but officially cool as hell. Zombie mechanics would be an amazing thrill to develop. There is an outrageous Sue Storm zombie card in the marveltcgonline.com card creating contest.
To celebrate the new comic they should have a Zombie/Army of Darkness Essential set. Zombie howard the duck FTW!
For the marvel Legends....there are a few villains I'd like to see. Proteus, Evil Scarlet Witch, Mandarin(Ring equips are a must), a new Annihilation Wave style Annihilus.
I'd like to see a Super Hero registration act card, or a Tragedy in Stanford card. New Nova from Annihilation. A Punisher that doesn't hardcore suck. The new Lady Ultron is pretty cool, assuming that the story doesn't go limp in the next few months. Something for the death of Cap would be allowable.

Ok, X-Factor. If you really wanted them as a mini team...
You could petition that some of the legacy content in the set is made up of dual-affiliated X-Factor characters, therefore you get a mini-"sub"-team in the set of the legacy characters. You obviously won't include all of the legacy stuff, but not only could you get the team included without having to devote much or any cardpool to them, but it might also help limited by making legacy just a little more viable.
So possible X-Factor dual-affiliations:
You could do (S.H.I.E.L.D./X-Factor: Jamie Madrox <> Multiple Man). They let on they were doing S.H.I.E.L.D. in 2008, so if this is the set it's featured in, that's an easily inclusion.
I'd also do a (X-Men/X-Factor: Strong Guy). He's a pretty iconic part of the team, and he doesn't really work as any other dual-affiliation except X-Men/X-Fac.. There's probably room in X-Men/X-Factor for another since it would be legacy for a team that was in the previous Marvel set, so you could also throw one of the other "Investigations" era team-members in there.
Then add one or two from the below list. They're generally not the most wanted inclusions I would think (I made the list with a pretty wide net), but they can be put in without "devoted card-pool" by DA'ing legacy content.
