Duo Attack and the Damage Depletion Modifier in 2022
For context, my venue is holding an event where all characters who have character cards are allowed. I will be using Colonel Stars and Stripes with Eisenhower attached from the KA2 set.
They have the duo ability.

DUO ATTACK
Give this character a power action. This character makes 2 combat attacks (close and/or ranged) as free actions and possesses during this action.
Seems cut and dry, right? But I seem to recall (and can’t for the life of me remember where) that retired abilities function as they were always intended, and Duo Attack used to be subject to the Damage Depletion Modifier, making it different from previous Flurry.

Give this character a close combat action. After the close combat attack resolves, it may make a second close combat attack as a free action. The first attack doesn’t activate the Damage Depletion Modifier.
Page 10 of the 2015 core rule book has the definition of the damage depletion modifier.

DAMAGE DEPLETION MODIFIER
Each time an attack resolves, modify the attacker’s damage value by -1 (minimum 1) until the end of the turn.
So my question is, when Colonel Stars and Stripes uses Duo, will the second attack be at full damage or -1?

A few rules are intentionally missing, as they are no longer part of HeroClix. One is the Damage Depletion Modifier. It doesn’t exist anymore, and some characters have gotten more powerful as a result. The one place it still applies is to Team Bases, as you will see when the Past Rules supplement is posted. It was originally developed to reign in Team Bases, but it didn’t need to be a general rule and was interfering with character design
